Harwich man gets probation for deadly crash

Source: Cape Cod Times, Hyannis, Mass.迷你倉Aug. 29--The driver of a pickup truck involved in a Bourne crash in February that killed two women, including a well-known Cape pediatrician, will not face jail time.Under an agreement reached Wednesday in Falmouth District Court, Zachary Jamous, 21, of Harwich, will be on pretrial probation for two years, perform 100 hours of community service and lose his driver's license for an additional six months.He was charged with motor vehicle homicide by negligent operation and negligent operation of a motor vehicle in the Feb. 15 accident on Sandwich Road.Jamous told police he fell asleep while driving home that night from the University of Massachusetts Dartmouth. His 2007 Toyota Tacoma drifted over the center line, struck a 2006 Toyota Corolla head-on and killed the two women, according to police reports.Hope Brooks, 81, of Forestdale, a retired pediatrician and a director at Camp Good News who was a passenger in the Corolla, died that night. The driver, Barbara Nix, 82, of Middleboro, died F文件倉b. 25.The agreement hinges upon Jamous staying out of trouble, said his attorney, Peter Lloyd. Jamous must regularly meet with a probation officer, update where he is working and living, as well as "obey all laws" to meet the terms, Lloyd said.If Jamous is arrested and charged with a new crime, the court will be notified and this case could be back on the docket, Lloyd said. Speeding or a traffic violation would not trigger a violation, he added.The judge can then decide if the new charge is severe enough to warrant the case returning to the docket, Lloyd said. "But 99 percent of the time it's kicked back," he said.Jamous has not made an admission of guilt and should he face no new charges, the case will be dismissed at the end of the two-year period, Lloyd said.
